This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from the proactively.io site or any web based Proactively software product (the “Site”). By visiting the Site you are accepting the practices described in this privacy policy.

Proactively is committed to protecting the privacy of our web site visitors and software customers. Our web site uses security measures to protect against the loss, misuse and alteration of any information under our control. We will never share, or rent individual personal information with anyone without your advance permission or unless ordered by a court of law.

Personal information we collect

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms that referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”

We collect Device Information using the following technologies:

“Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. For more information about cookies, and how to disable cookies, visit http://www.allaboutcookies.org.

“Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.

Additionally when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, payment information (including credit card numbers, Paypal, email address, and phone number. We refer to this information as “Order Information.”

When using the service you will input information, “Content Information”. The information uploaded onto the online database for both clients and clients’ employees, sub-contractors or agents is the responsibility of the client and their administrative users. Proactively recommends that no sensitive information be stored directly or in-directly on the database. Furthermore if clients are storing documents that contain any sensitive information then this should be blanked out or removed before uploading files. You will be able to restrict access to this information through settings.

When you use a location-enabled Proactively service, we may collect and process information about your actual location, like GPS signals received by a mobile device.

How do we use your Personal Information

If you are a European resident we note that we are processing your information in order to fulfil contracts we might have with you, or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information may be transferred outside of Europe, including to Canada and the United States.

We use the information that we collect generally to

  • Fulfil any orders placed through the Site (including processing your payment information, and providing you with invoices and/or order confirmations);

  • Communicate with you in order to provide you with information we think may be useful or relevant to you;

  • To promote our services or related services

  • To improve and optimise our Site (for example by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns;

  • Screen our orders for potential risk or fraud;

  • To use the name you provide for your Proactively’ profile across all of the services we offer that require a Proactively’ Account. If other users already have your email, or other information that identifies you, we may show them your publicly visible Proactively’ profile information, such as your name and photo;

  • When you contact us, to keep a record of your communication to help solve any issues you might be facing. We may use your email address to inform you about our services, such as letting you know about upcoming changes or improvements;

When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

You will be added to Proactively’s email newsletter list if you are an existing customer or you register to receive information via our contact form / web demo form on the Proactively’ or associated product websites. Emails are sent through our email marketing provider Mail Chimp. Each email sent contains an easy, automated way for you to cease receiving email from us, or to change your expressed interests.

We may include customer testimonials on our web site which may contain personally identifiable information. We obtain the customer’s consent prior to posting the testimonial.

Proactively’ processes personal information on our servers in countries in the EU. We may process your personal information on a server located outside the country where you live.

Making payments

We outsource processing of credit card transactions to Stripe, our payment processor. We securely transmit your credit card information to Stripe. Stripe does store this information. Stripe maintains that it is PCI compliant. Please visit Stripe’s privacy policy for information regarding Stripe’s collection, use, and transfer of Personal Information, stripe.com/us/privacy. We request your phone number and email address so that we can reach you should further verification of your credit card information be required. Other than the last four digits of your credit card and the brand of the credit card, Proactively’ does not store, process, or transmit any other cardholder data in electronic format and is in compliance with SAQ A data security standards issued by the Payment Card Industry Security Standards Council.

Sharing your Personal Information

You may set your browser to block all cookies, including cookies associated with our services, or to indicate when a cookie is being set by us. However, it’s important to remember that some of our services may not function properly if your cookies are disabled. For example, you may not be able to login to Proactively’ or utilise other services.

We may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

Accessing Personal Information

If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted.

Whenever you use our services, we aim to provide you with access to your personal information. If that information is wrong, we strive to give you ways to update it quickly or to delete it – unless we have to keep that information for legitimate business or legal purposes. When updating your personal information, we may ask you to verify your identity before we can act on your request.

We may reject requests that are unreasonably repetitive, require disproportionate technical effort (for example, developing a new system or fundamentally changing an existing practice), risk the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup tapes).

Where we can provide information access and correction, we will do so for free, except where it would require a disproportionate effort. We aim to maintain our services in a manner that protects information from accidental or malicious destruction. Because of this, after you delete information from our services, we may not immediately delete residual copies from our active servers and may not remove information from our backup systems.

Information Security

We have systems in place to protect Proactively’ and our users from unauthorized access to or unauthorized alteration, disclosure or destruction of information we hold. In particular:

  • We encrypt many of our services using Secure Sockets Layer (SSL) or Transport Layer Security (TLS).

  • We review our information collection, storage and processing practices, to guard against unauthorized access to systems. Our server providers have been selected on the grounds of security and regular back up.

  • We restrict access to personal information to our employees, contractors and agents who need to know that information in order to process it for us.

Minors

The Site is not intended for individuals under the age of 16 years.

Changes

We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
